Local Authority to Maintain Public Drains :


1).Public drainage should be maintained by local bodies:


a).Each urban local government body shall construct and maintain a public drainage system sufficient and adequate to accommodate the funds available for the efficient disposal of sewage within its local government area.



b) If, in the opinion of the Government, a public drainage system or any other means of drainage should be established in the local government area or any part thereof, for any special reason, the Government may direct the local government body to cause or execute such construction works as may be deemed necessary by the Government within a period specified by the Government for this purpose.


c) All drains, culverts, etc., appropriated or belonging to the local body shall be maintained at all times in a state of repair.

2). Power of Health Officers to Require Drains to be Constructed:


(1) If, in the opinion of the Welfare Officer, the premises or any facility for efficient drainage is insufficient, he may, by notice, direct the owner of such premises to construct a drain connected to the nearest public drain from the premises, or to any other place specially designated by the local authority for the discharge of sewage. but,

 a. The cost of constructing the portion of said drainage situated more than one hundred feet from the said premises shall be paid from the funds of the local body concerned; and

b. In the opinion of the Welfare Officer, public drains or separate drains shall be provided for the disposal of sewage within a reasonable distance from the premises of such plot.


i)Unless there is no other place reserved.  of the material, size and description of his work shall include a covered cistern, a cistern, a cistern, or other construction and


ii) he may, by notice, require the owner of the premises to construct a house drain connected with such covered cistern, filter basin or construction.


2). Where a local authority alters its drainage system or undertakes a new drainage system, the owner of the premises may require the owner to rebuild or alter any drains, and the cost of rebuilding or altering such drains shall be apportioned, either wholly by the local authority or wholly by the owner or by the local authority in accordance with such rules as may be prescribed. Acceptance by part owner.


3).Drains in Private Streets:



In any private street common to more than one tenement, where a house drain belonging to one or more tenements has been constructed and the sewage from any other tenement is disposed of into that drain, the Welfare Officer may, by notice, require the owner of the tenement to connect his house drain to the specified drain. The owner or owners of the particular drain is first bound to consent to the establishment of such connection. But

(a). Corresponding possessors between each other or Except on such premises as may be agreed upon by the owners, or


(b). In the absence of such agreement, no such annexation shall be made except on such terms as may be imposed by the local body and unless and until any due payment is duly made by such local body to the owner or owners concerned.

4).DRAINAGE FOR EQUIVALENTS :  


a)The drains for drainage from the huts shall be constructed of such size and description and materials as may be considered practicable by the Welfare Officer having regard to the local conditions and the location of the nearest public drain or other place designated separately by the local body for the discharge of sewer water.


b).If the Welfare considers that a new drain should be constructed for the benefit of the occupants of any cottage, he may by notice require the owner of the land on which the cottage is situated to construct such a drain: such owner shall also construct such drain and clean it to the satisfaction of the Officer. Repairs are also required


5).Sanitary Conveniences


b)  Obligation of Local Authority to Provide Sanitary Convenience)?


Every local authority shall ensure that adequate number of sanitary latrines are provided at convenient places for public use and all such places shall be maintained in such a manner that they are not a nuisance or injurious to health.


a).New house to be Presided with Sanitary Convenience:


If any building for human habitation is constructed or demolished at or below the ground level and then renovated and rebuilt in any local authority area, the Welfare Officer shall, by notification, require the owner of the premises to provide excrement closets.
