Abatement of Nuisances


1). Certain Things to be Nuisances :


Notwithstanding the generality of the definition of the word "nuisance" contained in clause (25) of section 41.3, for the purposes of this Chapter, the following shall be specifically deemed to be nuisances :


(1). Any premises which are injurious to health or are in a nuisance condition.


(2). Any pit, ditch, drain, culvert, cistern, latrine, cesspool, drain or cesspool, which has a foul odor or is in a condition which is likely to be injurious to health or a nuisance.


(3). Any animal housed in a place or manner likely to be injurious to health or a nuisance.


(4). Any pile or deposit of waste or other material which is injurious to health or a nuisance.


(5). A factory which is not adequately ventilated, is not adequately ventilated or is not kept clean or is not cleared of harmful emissions or is overcrowded in such a way as to be harmful to the health of those working there. Any workshop or workplace which is not a factory is governed by the categories of Factories Act, 1934.


(6). A plant that does not use as much as practicable without emitting smoke from the fuel used in the furnace or furnace. Factory, dyehouse on dye road, bakery or gas production road in any or any manufacturing or commercial process Any fire stove or furnace used to operate traps by steam.


(7) Any chimney which emits smoke in such a quantity as to be a nuisance. And


(8). Any noise, volume, dust, burning coal dust, irritating smell or obnoxious foul odor caused by a factory, workshop or workplace which is a nuisance to the people in the neighbourhood.


Each of the urban local bodies –



2. Detection of Nuisances:


a). shall cause periodic inspections of the local authority area to ascertain what nuisances exist in its local authority area which are required to be abated in accordance with the powers conferred on such local authority by this Act. And


b). The provisions of this Act shall be enforced to remove such nuisances.


3. Information Regarding Nuisance:


Any person impaired by a nuisance in any local authority area. The Welfare Officer or any other officer belonging to the People's Welfare Staff of the local body may be informed about the same.


4. Power of Health Officer to Abate Nuisance:


If the welfare officer is satisfied, on information given under section 43 or otherwise, that there is a nuisance, he shall, by the act, wrongdoing or connivance of any person, cause or continue to cause the nuisance, or, if that person cannot be found, the premises on which the nuisance arises or continues. The owner or occupier of the premises shall be informed of the encroachment and steps shall be taken to cause the necessary repairs to be carried out. Can be requested by notification.
